The Malta International Food Festival 2014

Belt Hompesch, Haz-Zabbar will be organising the 2^nd Edition of the Malta on Saturday the 31^st of May in collaboration with the Malta Tourism Authority, the Zabbar Local Council and the festa band clubs and societies.

Following last year’s success big preparations are underway to welcome hundreds of Maltese and tourists for this culinary festival in the streets and piazzas of Zabbar which will be transformed for the occasion.

Puttinu Cares Marathon 2014 to be held on the 6,7 & 8th June - This year commemorating the 10th Anniversary

More than 30 families from the Maltese Islandsgo for treatment in 40 different hospitals in UK. The most two hospitals used by the majority of patients are the Great Ormond Hospitalwhich caters mainly for children and the Royal Marsden Hospital which specialises in treatment for cancer.

These patients spend weeks, months and even years abroad having treatment.

Puttinu Cares has a dream – That there comes a day when no patient will have to pay anything for accommodation when they need to go abroad for treatment. We are still half way to make this dream come true since at present, Puttinu Cares owns 16 apartments near the Royal Marsden Hospital in Sutton (attached find some photos) which hundreds of families made use of them free of charge. In all these apartments amount to 4.4 million euros out of which 1.4 million still needs to be repaid back.

Our main sponsor is the annual football marathon where more than 800 football teams participate in 60hours. This activity is held on a national level where we have media coverage throughout the three days and support from the head members of the state who all visit the marathon. This year we are celebrating the 10^th Anniversary and our aspiration is that we will keep on raising funds so that we will achieve our goal to continue to help these families in need with the sole intention of easing their hard experience. The marathon is going to be held between 6 – 8^th June at Marsa Sports Grounds.

1) How Puttinu makes use of its funds

The money you donate to Puttinu Cares is being used to repay a loan on a block of 12 apartments which were purposely built in Sutton to freely accommodate families of patients receiving treatment at the Royal Marsden Hospital. This relieves patients and their families from financial pressures during delicate times of life. The apartments are within walking distance from the Hospital. Your donations also help to cover all services within the apartments, from telephone, water and electricity, rates, insurance, television and internet. 2) Who Puttinu Cares helps

Although Puttinu Cares Foundation started out as a children’s charity, it now extends its financial and moral support to any patient in need of accommodation in UK and not just children suffering from cancer. They have opened up their accommodation in Sutton to these people as well. Hundreds of patients and their families have benefited from these apartments during the years.

3) How much money is required

The project to build the Sutton apartments cost a staggering € 3.4 million. Bank Of Valletta, gave Puttinu Cares a tailor made loan, which is repaid at intervals, when donations are received. Puttinu Cares still needs to repay € 1.4 million. It also costs Puttinu Cares another € 500,000 annually to cover those patients and families who do not go to Royal Marsden Hospital for treatment but goes to other hospitals around the UK.

Air Malta leases aircraft to Monarch Airlines

Air Malta has signed an agreement to lease out an Airbus A320 aircraft to Monarch Airlines for a period of 19 months.

The contract with the privately-owned British airline commenced at the end of April 2014 and will end in the beginning of November 2015.

Air Malta’s Chief Commercial Officer Philip Saunders was very positive about working with another EU-based airline.

“The leasing section has been very active over the past couple of months. We made sure we secured two aircraft leases in line with the EU-approved restructuring plan,” said Mr Saunders.

Meanwhile, Air Malta has just taken re-delivery of one Airbus A320 aircraft at the end of its lease with Interjet of Mexico. This aircraft, which had an Interjet livery, was repainted in the first Air Malta livery as part of the airline’s celebrations of its 40th anniversary since the start of its flying operations.

In line with the Restructuring Plan Air Malta currently operates with a fleet of 10 aircraft, 6 Airbus A320 and 4 Airbus A319.

Air Malta launches the summer 2014 schedule

Air Malta unveiled its summer 2014 flight schedule offering customers a selection of 165 weekly flights to 33 destinations around Europe, northern Africa and the eastern Mediterranean.

This summer the national airline added two new routes to its network; Venice (Marco Polo Airport) and Parma (Giuseppe Verdi Airport). This season it will again operate to Algiers and has changed airport in Istanbul to Sabiha Gokcen Airport, the world’s fastest growing airport.

“Air Malta’s strategy is to operate a conveniently timed flight schedule to a number of central airports which are conveniently located to access the cities they serve. We have a wide network of routes to hub airports which also allow for good connections with our partner airlines beyond our network. Ta' Mena Estate

Ta’ Mena Estate is owned by the Spiteri family and was founded by their late mother Carmela, popularly known as Mena, who worked hard to purchase and cultivate the land until her pre-mature death in 1986, when the project was partially shelved.

In 2002 the Spiteri Family decided to start again to regenerate and enlarge this estate which now covers around 25 hectares of agricultural land with over 95,000 vines, 1500 olive trees, 800 orange, lemon and mandarin trees and 600 fruit trees. There is also a small farm on the estate with goats, sheep, rabbits, chicken, pigeons and other poultry. The Spiteri's are practically realizing their late mother’s dream of integrating agriculture with tourism so that one sector sustains the other. Ta' Mena Estate also has a state of the art winery with underground cellars where they produce premium white, rose and red wines under the brand Marsamena Wines. They also have a food producing facility where they produce the Cold Pressed Extra Virgin Olive Oil, their well known Traditional Tomato Paste which is matured by the sun, various jams, liqueurs, pure honey, carob syrup, capers, olives and many other traditional food products. When buying a property in Malta and Gozo, the first step is to draw up a contract for a promise of sale, sometimes called a convenium. The convenium will be signed in the presence of a notary, often of the prospective buyer’s choosing. A convenium is basically a preliminary agreement and is normally valid for three months. When the convenium document is signed a deposit is paid by the buyer, normally equivalent to 10% of the overall purchase price of the property.

Meanwhile, the purchaser will be able to present a copy of the contract to his bank in order to obtain the necessary financing (if applicable).

It is advisable that in consultation with an architect, a detailed survey of the property in question is carried out. This will help evaluate the structure conditions while making sure the property is in line with all building regulations. Any breach or else will make the buyer liable after the sale has been concluded.

During the convenium period the buyer can present the promise of sale in a bank to obtain any necessary financing to purchase your property. We also advise you to consult with an architect, who can prepare a detailed survey of the property. This will include an evaluation of the structure and its condition and ensure the property is in line with all building regulations. This is wise as if any irregularities are present, the new buyer will be liable to them.

If you are selling a property in Malta and Gozo, it is advisable to make sure that all the relevant papers and permits are in order during the convenium period. It is also the time to honour any agreements with the buyers, such as works, alterations or finishing.

At the end of the convenium period, provided all agreements are fulfilled and disputes settled, the buyer pays the remaining balance due and takes ownership of the property. The seller presents the keys of the property to the new owner and the notary will register the transfer of property at the Maltese public registry. Needless to say and especially if you have any questions or doubts, prior to finalizing any property purchase, it is advisable to consult a lawyer.

Rain all over Malta expected this weekend came out of nowhere! Do you think that the US Airforce is messing with our weather?

Yesterday reports came in from various people reporting strange lines in the sky, especially in the south of Malta. Today the weather in Malta is gloomy and rainy and it seems that no weather forecast predicted such weather especially after Malta and Gozo experienced weeks of sunny and clear skies.

"This strange weather came out of nowhere!" commented someone on our facebook page, "could it be connected to yesterday's strange marks and lines in the sky" said someone else.

Various questions arise,

Is it true that a foreign military force, possibly the US Airforce might be sending drones over Malta to release chemicals in the sky to force clouds to form, rain to come down and eventually to cool off the planet after years of increasing temperatures?

Why are these strange aircraft appearing over Malta? If this is true are they targeting the entire Mediterranean or perhaps Northern Africa or just Malta?

If such weather control is taking place this might be only a temporary solution and what about 'side effects' from such tweaking with nature?

Can Malta as a sovereign country decide not to allow such experiments on weather control to take place on our territory?

According to the chemtrail conspiracy theory, long-lasting trails left in the sky by high-flying aircraft are chemical or biological agents deliberately sprayed for sinister purposes undisclosed to the general public. Believers in the theory argue that normal contrails dissipate relatively quickly, and contrails that do not dissipate must contain additional substances,but their arguments have been dismissed by the scientific community: such trails are simply normal water-based contrails (condensation trails) which are routinely left by high-flying aircraft under certain atmospheric conditions.

Although proponents have attempted to prove that the claimed chemical spraying does take place, their analyses have been flawed or based on misconception.

The Minister of Tourism was also asked to make the facts about the air trails some weeks ago by various media outlets. He said that air traffic control communicates with all airplanes that travel in Maltese skies, but when asked to give a guarantee that the trails where not chemtrails he said that just like other countries he could provide no guarantee.

The local search engine www.FirstMalta.com has published statistics showing that the Maltese are amongst the most engaged on Facebook around the world and spend lots of time looking for adult related keywords online.

Statistics collected from the search engine reveals that an astounding 203,200 Maltese have a Facebook account, when one considers that the population between 15 and 64 is 279,809 (1) we can consider that 72.6% of the adult population have a Facebook account.

Other European countries have far less Facebook registration, for example Germany has only 45% of the adult population registered, whilst Luxembourg has 68%. The United States score at 74% which is only slightly higher than the Maltese population. (2)

Top searches registered on the firstmalta.com search engine show that adult related searches top the charts. A spokesperson for FirstMalta.com commented that such trends are very similar to what other European countries are experiencing and it comes to no surprise that Malta’s trends are similar seeing that our internet infrastructure is as advanced as these countries.

The search engine www.FirstMalta.com has also been able to gather information related to the Maltese preference in mobile phone and tablet type usage. It seems that 66,100 people use an Android device and 47,800 use an Apple operating system. Friends of the Earth Malta believes that Valletta infiorata sends out a contradictory message regarding environmental sustainability

Friends of the Earth Malta is happy to note that environmental consciousness and sustainability are targets for the V-18 programme following a statement made by chairman, Jason Micallef regarding plans to place a floral carpet in St. George’s square for the Valletta Foundation 2018 events. FoE Malta has however expressed doubt at the effectiveness of presenting a floral carpet using species which are not native to the Maltese islands, namely petunias and pansies.

JD Farrugia from Friends of the Earth Malta says: “Petunias are a genus of species which originate from South America and a Pansy is a hybrid plant which is derived from plants commonly found in the Northern Hemisphere. Placing a large amount of these flowers in Valletta and passing it off as a way to raise environmental consciousness and promote environmental sustainability is a contradiction.”

“The promotion of local flowers and plants sends out a stronger message about our environment and ties in a lot more with an event which is meant to promote the culture of the Maltese islands. The use of non-native species in such events as well as in public spaces like roundabouts also means that they require more maintenance such as irrigation, pesticides and the use of herbicide such as glyphosate.”

Last year, Friends of the Earth Malta found traces of glyphosate in the urine of 90% of a sample of Maltese people during a study carried out by Friends of the Earth Europe. The same herbicide is commonly sprayed on such non-native species on local roundabouts and public spaces by the ELC itself, who is organising the infiorata which is set to happen in Valletta.

Air Malta inaugurates flights to Istanbul’s Sabiha Gökçen Airport

Air Malta has inaugurated flights to Istanbul’s Sabiha Gökçen Airport after moving from Istanbul’s other airport, Atatürk.

“Sabiha Gökçen Airport serves a growing and largely untapped catchment area within the Asian side of Istanbul and other cities to the south,” said Philip Saunders, Air Malta’s Chief Commercial Officer during a visit to mark the inaugural flight.

“The airport will provide us with more operational flexibility,” he added, before cutting a cake with the management of the airport.

The airport, named after the world’s first female combat pilot Sabiha Gökçen, is the world’s fastest-growing airport serving more than 19 million passengers annually.

Sabiha Gökçen airport is situated on the eastern side of the Bosphorus strait and therefore forms part of the Asian side of the bi-continental city.

This airport is only 40 minutes away from the city centre by taxi and is served also by a variety of efficient transport modes including dedicated Express airport buses and public transport. A shuttle bus to the metro station nearby provides access to metro lines and the Marmaray tunnel that connects the two sides of the city underneath the Bosphorus.

Air Malta’s flights follow last summer’s schedule of three weekly flights every Monday, Wednesday and Thursday. Connections are available to other airports beyond, primarily within Turkey.

The historical city of Istanbul is Turkey’s economic, cultural, and historical heart. Its attractions include towering minarets, underground Byzantine cisterns and steamy bathhouses.

Interview with Helga Ellul, candidate for the 24th May 2014 MEP elections

What prompted you to get involved into politics?

Presenting myself as a candidate for these MEP elections is a way in which I can give something back to my adopted country, Malta, where I have lived for forty years, where I have made my career and raised my family. During these years, I have come to appreciate the values which drive most Maltese, as well as the economic potential of these islands. I am also privileged to be considered as an MEP candidate on behalf of the PN, the Party has always been a firm believer in the ability of the Maltese to carve their own future, seek pastures new and overcome all adversity.

How do you feel you can contribute if elected to the European Parliament? and how do you feel you can represent the Maltese better in the European institutions?

Ultimately, an MEP should utilise her experience and skills to the benefit of her constituents. Thus, in my case I can utilise my extensive experience in manufacturing, HR management and business strategy, for their benefit. An MEP also requires the skills necessary to debate and negotiate successfully on issues that matter to them. One’s capability to contribute to Parliamentary committees, in my case those which focus on business, innovation and employment, is also very important. Finally, a successful MEP needs to be a firm believer in working relationships and negotiations.

I would say that my experience and track record speak for themselves. Under my leadership, Playmobil Malta became a major player in Malta’s manufacturing industry and by the time I retired, we were employing over 1,000 people (from an initial 50). I consider the introduction of innovative ways to develop the potential of our people there as a major achievement. Meanwhile, promoting Malta became second nature to me, and I took part in various official delegations to attract investment to Malta. I helped set up the Foundation for Human Resource Development, was a member of MCAST’s Board of Governors for ten years, and was President of the Malta Chamber of Commerce and Industry. All of this has has bound me closely to Malta’s destiny.

Why have you chosen to represent a political party in these elections? Do you think that you could have contributed more or less if you were elected on an independent ticket?

I am priviliged to have been asked to participate in these elections under the banner of the Nationalist Party, the party which believed in Europe from the very beginning; the party which guided Malta towards membership, and worked hard and effectively to make membership work for Malta. I feel that as part of the PN team at the EU parliament and within the wider umbrella of the EPP, I can work together with other MEPs from Malta and the other EU countries more effectively, and my contribution can be more concrete.

Do you believe in a federal, more united European Union were a centralized government decides the faith or all the European citizens with common laws or do you think that the European Union should steer away from such a scenario?  Which one do you think would be more advantageous for the Maltese?

I would prefer a more a more centralized Europe as this would mean a Europe which provides a level playing field for all member countries irrespective of size, population, economic power, etc.

Do you think that the present Government is European friendly and why do you think that many Maltese seem to be losing faith in the European Union as an institution?

This government is not very Euro-friendly, as the tone of its communications on anything to do with the EU is based on an ‘us and them’ attitude.

What is the first thing you would do, or try to at least, if elected to the EU parliament?

Certainly, the many challenges concerning the creation of jobs and youth employability will be at the top of my agenda. This would include issues which concern us all, such as lifelong education, employment, competitiveness and economic growth. I will also work for mental health issues, especially those related to the workplace, to be brought more to the centre of the EU agenda. This is a delicate yet fundamental area of concern to citizens, businesses and governments.

What do you think about illegal immigration? Do you think that the EU is doing enough or do you think that we need more help, both financially and socially?

Irregular immigration is European problem which requires European solutions. We are already getting different kinds of assistance from the EU, however since we have a higher rate of immigrants per capita the concept of burden sharing becomes even more important. However, one has to note that irregular immigration would have occurred even if we weren’t part of the EU. How would we have handled it alone?

And finally... Why do you think that the Maltese (& Gozitans) should vote for you?

Whatever I’ve been involved in throughout my life, I have always given my best and satisfied the expectations of those who put their trust in me. Given my background in international business and a life-time focus on human resource management, I have made it clear that my presence at the European Parliament would be a focused one, targeting those areas where I feel I can contribute most, namely the work of the Employment and Social Affairs Committee, particularly issues such as workers’ rights, training, and conditions of work; the Internal Market Committee, where my business experience and knowledge could prove to be an important asset, and the Environment, Public Health and Food Safety Committee, where I could contribute towards the discussion on mental health issues, particularly in relation to the workplace. 

Interview with Charlon Gouder, candidate for May 24, 2014 MEP elections

FirstMalta.com : 1. What prompted you to get involved into politics?

Despite my age, I have been active in the Labour Party for many years. I was brought up with Labour Party roots. As from a young age I started contributing to the politics of the Labour Party. When I was a student at Junior College, along with the rest of my team, we were the first group of Junior college students pertaining to a party with Socialist principles to win the Junior College elections.

Later on in life, I contributed actively to the Labour Party through my work on the media and, for many years, my name was associated with stories that dominated the Nationalist administration.

Most importantly, I was part of the change that the Maltese and Gozitan people voted for in the election which was held approximately a year ago.

2. How do you feel you can contribute if elected to the European Parliament? and how do you feel you can represent the Maltese better in the European institutions?

First and foremost, in the European Parliament I can contribute to drive further the Maltese government’s progressive project that it embarked on in March 2013 on many different levels. It is not by chance that I chose the words ‘Determination and Loyalty’ as the motto for my campaign.

These are not just buzz words. Those who are close to me and know me well will probably agree that these two words define me as a person. I am loyal, as I have always been towards the Labour Party and my country, through thick and thin. I am a person who is driven by determination and I have a talent for moving people in the right direction. I am not a person who gives up, and I believe that these qualities will help me represent my country and its people well in a Parliament where loyalty, drive and determination are necessary qualities for success.

3. Why have you chosen to represent a political party in these elections? Do you think that you could have contributed more or less if you were elected on an independent ticket?

Today I understand more than ever the progressive project of the Labour Party in Government: to return our country to its people in a much better state than the state we found it in, in March 2013. I could not have been better motivated to run for the EP elections had I not been part of such an ambitious and positive political direction as the one the Labour Party believes in.

Today, I understand more than ever that the work we have been doing on a local level needs to go beyond the shores of our islands. What happens in Europe, affects us directly and on a daily basis. We therefore have to make sure that we are there to affect Europe, through our positive and progressive project, in the same manner as it affects us.

4. Do you believe in a federal, more united European Union were a centralized government decides the faith or all the European citizens with common laws or do you think that the European Union should steer away from such a scenario? Which one do you think would be more advantageous for the Maltese?

As I said, what happens in Europe has a direct impact on Maltese and Gozitan families on a daily basis. Whatever direction the EU decides to take, we will always be affected by what happens at an EU level. It is therefore of utmost importance that the work of the MEPs energizes the European Parliament so that with great determination they can protect and militate for the interests of their country and its people. Only in this way can we ensure that Malta’s small size does not lead to any kind of inferior treatment.

I do not believe that a more united Europe with one central government will solve the problems of Malta, or of any other individual Member State for that matter. We cannot ignore the geographical facts and cultural basis defining each country. Our country is physically detached from the rest of Europe. At some level, this will always have an effect. I believe that each Member State needs to retain a certain amount of autonomy, especially in certain areas, which will permit each State to continue striving primarily for the interests of the country he or she represents, whilst harmonizing certain areas which can help all of the Member States move in the same, positive direction, for all of Europe’s benefit. Europe is changing fast and we need to keep track of its development. The next five years will see an enhancement of negotiations with US and China on the trade front and a multitude of new developments in new areas which will depend on the new commission which is yet to be nominated. Most of the next five years are not visible now.

What is sure is that Europe is at a cross-roads and we need 6 strong voices in Brussels and in Strasbourg to carry our flag.

5. Do you think that the present Government is European friendly and why do you think that many Maltese seem to be losing faith in the European Union as an institution?

I think one of the reasons why Maltese people are losing faith in Europe is because they are not being exposed and made aware of the direct impact decisions at a European level, whether positive or negative, have on our economy. Irregular immigration is another issue creating a certain level of contempt towards the EU as an institution, not only amongst Maltese people but amongst all people of Member State which are directly affected by this phenomenon. Apart from all this, we have also had the unfortunate experience of seeing other Member States’ economies struggle during the economic crisis, whilst Member States, such as Malta had to contribute financially to help them get back on their feet.

However, I believe that if Member states and their MEPs act responsibly and ensure that the interests of the Member State they represent are being respected within the European sphere, than I am sure that our position in Europe will be of benefit and the Maltese people will see this. In light of this, it is clear that the current Government is a European friendly government. As I have already stated, we cannot physically be in

Europe and act as if we are not affected by it. It will always affect us and therefore we cannot live outside of it, even if we had a choice. We need to use our physical and political position in Europe for the benefit of our country, first and foremost, whilst contributing to the benefit of other Member States.

6. What is the first thing you would do, or try to at least, if elected to the EU parliament?

It is difficult to choose one issue since there are many areas which are of concern and which I want to improve. Immigration is one of those problems. However, this does not exclude other areas which I believe are also of great importance, such as better access to the Single Market by Maltese SMEs.

7. What do you think about illegal immigration? Do you think that the EU is doing enough or do you think that we need more help, both financially and socially?

Immigration will definitely be on top of my agenda. I do not feel that the EU is doing enough and I believe that we need to start addressing the problem of irregular immigration from its roots. I also feel that financial and social help is not enough. We need to go further than that. There needs to be better communication and cooperation between all the EU Member States and the countries from where the greatest number of irregular migrants are moving on and passing towards Europe. We need to protect those who need protection but we must recognise, acknowledge and address the fact that there are also those who are abusing and exploiting the situation.

I will not just take a stand by showing solidarity with immigrants. In the European Parliament I will continue driving the strategy of the Maltese Government further and will definitely not give up in the face of this challenge which is greatly affecting our country and the rest of Europe.

8. And finally... Why do you think that the Maltese (& Gozitans) should vote for you?

I feel that I have the necessary qualities, educational background and work and life experience that an MEP requires to work effectively in the European Parliament and other fora on a European level. My background in law has given me the best training I could have received to contribute as a European lawmaker. On the other hand, my background as a journalist has given me the best training for a communicator of Europe.

I have been working in the political arena for many years.

I have seen different aspects and have always been close to the people, whatever I was doing in relation to politics. Further to my political and journalistic background, if you add my interest and educational background in the legal profession and European studies, I think that I have a lot to offer both to my country and the EU in general. These are some of the few reasons why I think the Maltese and Gozitans should vote for me.

Ultimately, my energy, drive, determination and loyalty to my country should encourage voters to put their trust in me on the 24^th of May.

Beaches in Malta

The tiny Republic of Malta is one of the most beautiful places in the world and can definitely be considered a gem of the Mediterranean Sea. Introduction to Judicial Review of Administrative Action in Malta An integral and pertinent part of administrative law is the judicial review of administrative action. Judicial review is the process by which a decision of a government department, authority or agency, may be reviewed and eventually annulled by the courts if it goes counter to the law.

The action is available to anyone who is aggrieved by a government decision or action which concerns them. Article 469A of Chapter 12 of the Laws of Malta is the operative article which grants such power to the courts. However, even in absence of any such legislative article, judicial review may be said to be an inherent power of the courts on the basis of the doctrine of the separation of powers embraced by any state which purports to be democratic.

Brief Background The doctrine of Maltese Judicial Review of Administrative action is akin to the English doctrine on Judicial review. This is so because the basis of Maltese Administrative law is English Common Law. Even before any codified law on judicial review existed (1964-1981) our courts still asserted their power of review of administrative action by relying on English Common law principles of judicial review.

In fact, the Maltese judgement Lowell v. Caruana (1972) established that English Common law is the basis of Maltese Administrative law in cases of lacunae. Article 469A states: "Saving as is otherwise provided by law, the courts of justice of civil jurisdiction may enquire into the validity of any administrative act or declare such act null, invalid or without effect only in the following cases: (a) where the administrative act is in violation of the Constitution; (b) when the administrative act is ultra vires on any of the following grounds: ii.when such act emanates from a public authority that is not authorised to perform it; or ii. when a public authority has failed to observe the principles of natural justice or mandatory procedural requirements in performing the administrative act or in its prior deliberations thereon; or iii. when the administrative act constitutes an abuse of the public authority's power in that it is done for improper purposes or on the basis of irrelevant considerations; or iv. when the administrative act is otherwise contrary to law.'

An administrative act or a government decision or action includes inter alia, the issue of licences, warrant, permits as well as orders. Prescriptive Period within which to File an Action The action against a government or other public authority is to be lodged in court within six months from the day upon which the government decision or action is taken, or licence or permit is officially issued, or from the day that the aggrieved learned of such a decision.

Maltese Court Decisions on the basis of Article 469A In an action for judicial review the court is empowered to impugn and declare null an action or decision taken by a government authority. However, the court cannot substitute its own decision with that of the government authority; where the decision of a government department has been annulled on the basis of unconstitutionality, ultra vires or illegality, the court can only order the government department to reconsider its action and take another decision.

The court can in no way order the government department to take a particular decision. Thus, the refusal of the Police Commissioner to grant a permit for fire-works display was quashed by the Court on the basis that he had based his refusal on a new policy not yet envisaged by the law. (1)A decision of the Board of Appeal of the Planning Authority was quashed on the basis that it had imposed vague and unclear conditions on the applicant.. (2)A decision of the University Rector to refuse entrance to a student was also successfully annulled. (3)The course to which the applicant had applied for was subject to a numerus clausus.

The court observed that the criteria upon which admissions to the courser were to be made had not been promulgated as law, as was required by the Education Act. Consequently, the contested decision was annulled as it had not been founded on any legal basis. Damages under Article 469A It is possible to claim damages under an action for judicial review. However, this is very limited.

Maltese doctrine excludes any claim for damages on the basis of psychological pain or distress. Thus, the only damages which will be granted are those which the applicant suffered materially (this may include loss of future earnings) as a consequence of the decision taken by the government or public authority. The successful challenge of a government decision or action does not automatically entitle the applicant to damages. Unless the government act is proven to have been executed in bad faith or if it is proven to have been unreasonable, then claim for material damages will be successful.

Thus, although the decision of the University Senate to expel a university student in her fourth year of studies was successfully quashed, her claim for material and psychological damages was denied by the court because the applicant failed to prove that the University Senate had acted unreasonably or in bad faith(4).
